IR35 is a set of tax rules designed to make sure people who work like employees pay broadly the same tax as employees, even if they operate through a limited company.
In simple terms, IR35 looks at how you actually work, not just what your company is called. HMRC is interested in things like:
* Who controls how, when, and where the work is done
* Whether you can send a substitute to do the work
* Whether you take financial risk and run your business independently
Based on this, an assignment will be assessed as either inside IR35 or outside IR35.
Outside IR35
If an assignment is classed as outside IR35, your limited company is treated as genuinely self-employed for that work. You invoice for your services, and you remain responsible for managing your own tax and National Insurance in the usual way.
Inside IR35
If an assignment is classed as inside IR35, HMRC treats the income from that assignment as employment-like for tax purposes. In certain agency arrangements — particularly those commonly used in sectors such as construction — Millison Chase Limited may be required to:
* Deduct income tax at source
* Deduct and pay a percentage relating to Employer’s National Insurance contributions, in line with the relevant legislation
This does not make you an employee of Millison Chase Limited, but it does change how tax is handled for that specific assignment.
What This Means for You
* Each assignment is assessed on its own merits
* The IR35 status may differ from role to role
* Where deductions are required, they are made transparently and in line with HMRC rules
* You will always be informed of the arrangement before work starts
Our role is to ensure compliance for our clients, subcontractors, and our business — while being clear and upfront about how each assignment is structured.
Please sign to say that you have fully understand the above
